Welcome to Belenci. The website belenci.co.za (the "Site") is operated by H & R GLOBAL CORP., trading as Belenci (email: info@belenci.com). The terms "we", "us" and "our" refer to H & R GLOBAL CORP. trading as Belenci. We operate this Site, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the "Services"). The Site is powered by Shopify.

These terms and conditions, together with the policies referred to in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights, warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you should not use or access our Services. Nothing in these Terms limits any right you have under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002 that cannot lawfully be excluded.

Section 1 – Access and account

By agreeing to these Terms, you confirm that you are at least 18 years old, or that you use the Services with the consent of a parent or guardian. To use the Services, including browsing our online store or buying products, you may be asked to provide information such as your email address and your billing, payment and delivery details. You confirm that all information you provide is correct, current and complete.

You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.

Section 2 – Our products

We make every effort to show our products accurately. Colours and appearance may differ slightly from what you see on your screen, depending on your device and its settings. Product descriptions may change at any time without notice. We may discontinue any product at any time and may limit the quantities we sell to any person or region.

Our products are personal comfort and self-care accessories for general use. They are not medical devices and are not intended to diagnose, treat or prevent any condition. If you have a health concern, please speak to a qualified healthcare professional before use.

Section 3 – Orders

When you place an order, you make an offer to buy. We may accept or decline an order at our discretion, and an order is accepted only once we confirm it and have received your payment. If we do not accept, change or cancel an order, we will let you know using the email address, billing address and/or phone number you provided. Returns and refunds are governed by our Refund Policy, which includes a 60-day money-back guarantee.

You confirm that your purchases are for your own personal or household use and not for commercial resale.

Section 4 – Prices and payment

All prices are shown in South African rand (ZAR). Prices, discounts and promotions may change without notice; the price you pay is the price shown at the time you place your order and confirmed in your order confirmation email. Delivery within South Africa is free. Any import duties or taxes levied by customs are explained in our Shipping Policy.

You agree to provide current, complete and accurate payment and account information and to keep it up to date. You confirm that you are authorised to use the payment method you provide and that you will pay the charges incurred at the prices shown.

Section 5 – Delivery

We deliver to addresses in South Africa only. Orders are processed within 2–5 business days and are then delivered within 12–20 business days after dispatch, so most orders arrive within 14–25 business days of being placed. These times are estimates, not guarantees, and may be affected by customs clearance, courier performance or events outside our control. Full details are in our Shipping Policy. Risk in the products passes to you on delivery.

Section 6 – Intellectual property

The Services, including all trade marks, brand names, text, images, graphics, reviews, video and audio, and their design, selection and arrangement, are owned by us, our affiliates or our licensors and are protected by copyright, trade mark and other intellectual property laws. You may use the Services for your personal, non-commercial use only and may not reproduce, distribute, modify, republish or transmit any material from the Services without our prior written consent. Shopify's name, logo and related marks are trade marks of Shopify. All other names and logos on the Services belong to their respective owners.

Section 7 – Optional tools

We may give you access to third-party tools that we neither monitor nor control. Such tools are provided "as is" and "as available", and your use of them is at your own risk and subject to the terms of the relevant third-party provider. New features we add to the Services are also subject to these Terms.

Section 8 – Third-party links

The Services may contain links to third-party websites. We are not responsible for the content, accuracy or practices of those websites, and any purchase or use of third-party products or services is between you and the third party.

Section 9 – Relationship with Shopify

The Site is powered by Shopify, but any purchase you make on the Site is made directly with H & R GLOBAL CORP. trading as Belenci. Shopify is not responsible for any aspect of sales between you and us.

Section 10 – Privacy

All personal information we collect through the Services is handled in line with our Privacy Policy. Certain information may also be processed by Shopify under Shopify's Privacy Policy, and by service providers that may be located outside South Africa, as explained in our Privacy Policy.

Section 11 – Feedback and reviews

If you send us ideas, suggestions, reviews or other content ("Feedback"), you grant us a worldwide, royalty-free licence to use, reproduce, publish and display that Feedback in connection with the Services. You confirm that your Feedback is your own, is truthful, does not infringe anyone's rights and is not unlawful, abusive or obscene. We may, but are not obliged to, monitor, edit or remove Feedback.

Section 12 – Errors and omissions

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, delivery times or availability. We may correct such errors and, where a product was offered at a clearly incorrect price, cancel the affected order and refund you in full.

Section 13 – Prohibited uses

You may use the Services for lawful purposes only. You may not use them to break any law, infringe anyone's intellectual property, harass or harm any person, transmit false or misleading information, send spam, impersonate another person, upload malicious code, scrape or crawl the Services, or interfere with their security. We may suspend or terminate your access if you breach these Terms.

Section 14 – Termination

We may end these Terms or your access to the Services at any time. Sections that by their nature should survive termination (including intellectual property, limitation of liability, indemnity and governing law) will continue to apply.

Section 15 – Disclaimer of warranties

Except as expressly stated by us, and to the extent permitted by law, the Services are provided "as is" and "as available". We do not guarantee that the Services will be uninterrupted, timely, secure or error-free. This does not affect the warranties and rights you have under the Consumer Protection Act 68 of 2008 that cannot be excluded.

Section 16 – Limitation of liability

To the fullest extent permitted by law, we, our directors, employees, affiliates, agents and service providers are not liable for any indirect, incidental, special or consequential loss arising from your use of the Services or any product bought through them. Our total liability for any claim relating to a product is limited to the amount you paid for that product. Nothing in these Terms excludes liability that cannot be excluded by law, including under the Consumer Protection Act 68 of 2008.

Section 17 – Indemnity

You agree to indemnify us against any claims, losses or reasonable legal costs arising from your breach of these Terms, your violation of any law or third-party right, or your misuse of the Services.

Section 18 – Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted, and the remaining provisions will remain in full force.

Section 19 – Waiver and entire agreement

Our failure to enforce any right or provision of these Terms does not waive that right. These Terms and the policies posted on the Site form the entire agreement between you and us regarding the Services.

Section 20 – Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations, provided this does not reduce your rights as a consumer.

Section 21 – Governing law

These Terms are governed by the laws of the Province of Alberta, Canada. This does not deprive you of the protection of any mandatory consumer-protection law of South Africa, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002, and you may bring proceedings in the South African courts where that law allows.

You can read the current version of these Terms at any time on this page. We may update them by posting changes on the Site. Changes do not apply to orders placed before the change was published.
